The association’s governing
documents were originally written by the
developer in 1977. The Board of Directors
attempted to pass a revision to the governing
documents; however, homeowners did not approve
the revision. Thus, the original documents
are current.
Homeowners should be aware that
parts of the original governing documents have
been invalidated by subsequent
legislations. Homeowners need to be aware
that the Board must follow current law where a
conflict with the governing documents exists.
